Apex Resource Management Solutions Ltd. (“ApexRMS”) processes Personal Information (as defined herein) when you visit the websites located at https://syncrosim.com/ and https://cloud.syncrosim.com (the “Site”) and when you submit data into its software-as-a-service offering, SyncroSim Cloud (the “Service”), located at https://syncrosim.com and https://cloud.syncrosim.com. This Personal Information is very limited but we still want, through this privacy policy (“Privacy Policy”), to inform you of the collection, use, disclosure and protection of the Personal Information processed by ApexRMS.

All references to “we”, “us” and “our” mean ApexRMS and all references to “you” and “your” mean users of our products or services, including our website. In this Privacy Policy, “Personal Information” means any information that can identify or is capable of being associated with a particular identifiable individual. If you are unsure whether you would like to provide information to us and/or having your information used as permitted in this Privacy Policy, you should not use the Site, the Service, or otherwise provide this information to us.

We encourage you to review this Privacy Policy on a regular basis, as it may be updated periodically.

1. Information gathering and use when you visit our site

Like many other websites, we use technologies to automatically collect technical data from visitors, in particular, we use cookies on our Site. Cookies are used to record visits and improve our Site, as well as to recognize the computer when revisiting our Site and customize your experience interacting with our Site. The systems we use anonymize your IP. We also aggregate information on what pages users access or visit, and information volunteered by the user.

2. When you use our service

When you register for an account to use the Service, the platform captures your log in information, your queries and your input. Cookies are used to record current session information, but we do not use permanent cookies. You are required to re-login to your account after a certain period of time has elapsed to protect you against others accidentally accessing your account contents.

Personal Information that we collect may include, but is not limited to, your name, phone number, credit card or other billing information to process payment for services, email address and home and business postal addresses. As noted above, you may refuse to provide us with your Personal Information. However, some Personal Information is necessary to process and fulfill orders for our services.

3. Data security

Even though we collect very limited Personal Information, we protect it for your privacy and security. We safeguard the security and confidentiality of your data using physical, technical, and managerial procedures. Please be aware that, despite our best efforts, no security measures are perfect or impenetrable.

Access to Personal Information is restricted to select authorized employees and representatives of ApexRMS on a need-to-know basis, and who are trained to handle Personal Information, and third party suppliers who are contractually bound to protect Personal Information and use only for purposes related to the Site or Service, according to applicable legislation.

Personal Information is retained during the period that your account for the Service is active, and may be kept following termination of Services in order to comply with laws, prevent fraud, resolve disputes, assist with any investigations, troubleshoot problems, and take other actions otherwise permitted by law.

4. Data storage

ApexRMS uses third party vendors and hosting partners to provide the necessary software and related technology required to run the Service. Third parties are contractually obliged to protect the information they receive. Personal Information may be stored or processed outside of Canada (whether by us or a third party vendor or hosting partner). In that case, it is subject to the laws of the foreign jurisdiction where it is stored, and may be accessible to that jurisdiction’s government, courts, or law enforcement or regulatory agencies upon request.

5. Your rights to your personal information

You may at any time contact us for further information regarding this Privacy Policy and our practices regarding the handling of Personal Information.

You also have the opportunity to request information on the type of Personal Information we hold about you, what it is being used for, and with whom it has been shared. You may also request access to your Personal Information currently held by ApexRMS. We will provide you with access to your Personal Information, subject to certain exceptions such as: any personal information about another individual that cannot be separated from yours , any information subject to solicitor-client privilege, commercially confidential information, information that may threaten life or security of an individual, or information collected for purposes related to an investigation of a breach of an agreement or contravention of law.

If you notice any inaccuracies or wish to update or complete any part of your Personal Information, you may request the correction or update of that information. When appropriate, the amended information will be transmitted to any third-parties having access to the Personal Information in question.

At any time, you may withdraw your consent to the collection, use, of your Personal Information, subject to contractual or legal restrictions. Please note that if you withdraw your consent, we may not be able to provide you with a particular product or service.

6. Disclosure

ApexRMS may disclose Personal Information under special circumstances, such as to comply with subpoenas or when your actions violate the Terms of Use. Personal information is not shared with or sold to other organizations for commercial purposes, except to provide products or services you’ve requested, when we have your permission, or under the following circumstances:

  • It is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Use, or as otherwise required by law.
  • To competent government, law enforcement or other authorities (i) if required as a matter of applicable law or regulation, or as a result of legislative, judicial or administrative requirements or changes; or (ii) if ApexRMS determines in good faith that disclosure is necessary to exercise or defend its legal rights or those of its users.
  • We transfer information about you if we are acquired by or merged with another company. In this event, we will notify you before information is transferred or becomes subject to a different privacy policy.

Where we share your Personal Information with third-parties, these parties are under legal and contractual obligations to comply with applicable privacy and data protection legislation, to protect your Personal Information, and to only use the Personal Information for the purposes in which it was transferred.
